16 September 2013: ICT-1 Daily Summary – Motiur Rahman Nizami, Application for Exclusion of Evidence and PW-23 Testimony

Today the Tribunal heard matters in the following case:

  1. Chief Prosecutor vs. Motiur Rahman Nizami

 In the case of Motiur Rahman Nizami, the Defense filed an application to exclude the testimony of Prosecution Witness 13, Shyamoli Nasrin Chowdhury, from the record. After hearing both sides argue, the Court passed an order. Thereafter, the Tribunal recorded the testimony of Prosecution witness 23, Sayeda Salma Mahmud.

Motion to Exclude Testimony

On 11 February 2013 the Prosecution filed an application under section 9(4) of the ICT Act, seeking permission to submit additional Prosecution documents, books, and CDs. On 20 February 2013 the Tribunal heard and allowed the application, pursuant to Order number 78. In closing submissions, the Defense submitted that they had applied for certified copy of that Order, but did not receive it from the Court until after they filed an application for inspection of the Order Sheets. 11 September 2013: ICT-1 Daily Summary – Motiur Rahman Nizami, Cross Examination of PW-21; Mobarak Hossain, Examination of PW-10

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Motiur Rahman Nizami
  2. Chief Prosecutor vs. Mobarak Hossain

In the case of Motiur Rahman Nizami, Defense completed the cross-examination of Yusuf Ali Biswas, Prosecution witness 21. He testified in support of charge 1. Thereafter, Tribunal adjourned the proceedings of the case until 12 September 2013.

In the case of Mobarak Hossain, Tribunal recorded the examination-in-chief and cross-examination of Abdul Hamid, Prosecution witness 10. Thereafter, Tribunal adjourned the proceedings of the case until 22 September 2013.

10 September 2013: ICT-1 Daily Summary – Motiur Rahman Nizami, Examination of PW-21

Today the Tribunal heard matters in the following case:

  1. Chief Prosecutor vs. Motiur Rahman Nizami

In the case of Motiur Rahman Nizami, the Tribunal recorded the examination-in-chief and cross-examination of Yusuf Ali Biswas, Prosecution witness 21. He testified in support of charge 1. Charge 1 alleged that the accused Motiur Rahman Nizami was responsible for the arrest, detention, torture and murder of Kasim Uddin and two others. It charges the accused with crimes against humanity specified in section 3(2)(a), 4(1) and 4(2) of the ICT Act 1973.

8 Sept 2013: ICT-1 Daily Summary – Nizami PW 19 and 20

Today the Tribunal heard matters in the following cases:

1. Chief Prosecutor vs. Motiur Rahman Nizami

In the case of Motiur Rahman Nizami the Defense conducted the cross-examination of Abu Sama Fakir, Prosecution witness 19, who testified in support of charge 4. The Tribunal then recorded the testimony of Tohurul Alam Mollah, Prosecution witness 20, who testified in support of charge 5. The Tribunal then adjourned the proceedings of the case until tomorrow, 9 September 2013.

In the case of ATM Azharul Islam today was scheduled for the Defense’s submissions on the framing of charges. However, the Tribunal adjourned the proceedings of the case until 18 September 2013. Continue reading →
