12 Feb 2013: ICT-1 Daily Summary – Chowdhury Direct and Cross-Examination of PW 19

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs Mobarak Hossain: Report on Investigation and Date for Submission of Formal Charges (Accused Present)
  2. Chief Prosecutor vs Abdus Sobhan  (Accused Not Present)
  3. Chief Prosecutor vs Salauddin Quader Chowdhury (Accused Present)

The Prosecution requested an additional seven days before submitting their Formal Charge against Mubarak Hossain. The Tribunal allowed their prayer and fixed February 25, 2013 for submitting the Formal Charge and extended the bail period till February 25, 2013.

On February 11, 2013 Tribunal heard an application filed by Abdur Razzaq requesting that law enforcement cease harassing Motiur Rahman Akond, Defense Counsel for Abdus Sobhan. Today the Tribunal passed an order directing the law enforcement agencies not to harass Motiur Rahman Akond.

Today, Wahidul Alam Junu, prosecution witness 19 in the Salauddin Quader Chowdhury case, concluded placing his testimony and Defense counsel Ahsanul Huq Hena concluded his cross-examination. Thereafter, Tribunal adjourned the proceedings till February 14, 2013.   Continue reading

10 Feb 2013: ICT-1 Daily Summary – Gholam Azam cross-examination of DW-1

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs Gholam Azam – Cross-examination of DW-1 (Accused Not Present)
  2. Chief Prosecutor vs Salauddin Quader Chowdhury: Cross-examination of PW 17 in-camera (Accused Present)

A number of administrative matters were brought to the attention of the Tribunal, including allegations of harassment of Defense counsel, in-camera examination of the witness, and Chowdhury’s counsel.

The Tribunal then began addressing items in the cause list, beginning with the Gholam Azam case. The Prosecution continued its cross-examination of DW 1, Abdullahil Aman Azmi, who is the son of Gholam Azam and a former Army personnel.

After the mid-day break Defense counsel for Salauddin Qader Chowdhury began their cross-examination of prosecution witness 17 in-camera.

4 Feb 2013: ICT-1 Daily Summary – Chowdhury PW 18, Gholam Azam Cross Examination of DW 1

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs Salauddin Quader Chowdhury: Prosecution witness 18 direct testimony (Accused Present)
  2. Chief Prosecutor vs Professor Gholam Azam: Prosecution’s cross-examination of defense witness 1 (Accused not Present)

In the Salauddin Qader Chowdhury case, prosecution witness 18, Debabrata Sarkar, began and concluded his testimony before the Tribunal. Thereafter, the state appointed Defence Counsel sought adjournment and Tribunal adjourned the case until February 6. Salauddin Quader Chowdhury also requested that the Tribunal consider an application, to be filed by a family member, for his release on parole to attend the Janaga for his uncle.

After the lunch break, Prosecutor Haider Ali cross-examined defense witness 1, Abdullahil Aman Azmi , in the Gholam Azam case. The Tribunal then adjourned the proceedings until tomorrow, February 05. Continue reading

29 Jan 2013: ICT-1 – Sayedee Prosecution’s Final Reply

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Professor Gholam Azam: Defense request for adjournment (Accused not Present)
  2. Chief Prosecutor vs. Mir Qasem Ali: Announcement of date for submission of formal charges or progress report
  3. Chief Prosecutor vs. Delwar Hossain Sayedee: Prosecution’s Reply to Defense Closing Arguments (Accused Present)
  4. Chief Prosecutor vs. Salauddin Qader Chowdhury: Rejection of review applications and hearing of application to allow Chowdhury to attend Parliament

Today the Defense Counsel for Gholam Azam sought adjournment for the day. The request was allowed and the case was adjourned for the day.

In the case against Mir Qasem Ali, which is still in the investigation stage, the Tribunal fixed March 3, 2013 for the submission of either the Formal Charge or a Progress Report of the investigation.

In the Sayedee case the Prosecution finished its reply to the Defense’s closing arguments and requested the death penalty. Thereafter, Tribunal officially closed the case, announcing that the case would be under consideration until verdict was issued. The Tribunal will give notice to both the Prosecution and Defense as to when the Judgment will be ready.

In the Chowdhury case the Tribunal rejected the Defense’s application, filed January 24, requesting contempt proceedings to be issued against the Daily Jugantor, its editor and publisher Salma Islam, and staff reporter Swapan Dash Gupta.  The Tribunal also summarily rejected two review applications filed by the Defense requesting review of two orders. They reasoned that the applications for review were not filed within 7 days of the orders, dated 3 December 2012 and 14 January 2013 respectively, and were therefore barred. The Defense also filed an application requesting that Chowdhury be allowed to attend a session of Parliament. The Tribunal heard the application and fixed January 30, 2013 for passing its order.
