18 November 2013: ICT-2 Daily Summary – Mir Quasem Ali, Defense Motions and Opening Statements again delayed; AKM Yusuf, PW-8

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Mir Quasem Ali
  2. Chief Prosecutor vs. AKM Yusuf

ICT-2 heard two separate Defense applications today, filed on behalf of accused Mir Quasem Ali. One sought disclosure of Prosecution documents, and the second sought disclosure of further details about Prosecution witnesses. The Tribunal granted the former but not the latter. The Prosecution then sought adjournment of the case until 10 December.  The Court directed the Prosecution to provide the Defense copies of all the documents pertinent to their motion on or before 25 November 2013.

In the case against AKM Yusuf, the Tribunal recorded the examination-in-chief of PW-8, and the Defense began cross-examination before retiring for the day. The testimony of PW-8 supports Charges 10, 11, and 13 faced by the Accused. Continue reading

17 November 2013: ICT-1 Daily Summary – Motiur Rahman Nizami, Closing Arguments; Mobarak Hossain, Prosecution Case-in-Chief

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Motiur Rahman Nizami
  2. Chief Prosecutor vs. Mobarak Hossain

In the case of Motiur Rahman Nizami, the Defense cross-examined the investigation officer Shyamol Chowdhury, PW-12.

In the case of Mobarak Hossain, the Tribunal heard an application filed by Defense under Rule 26(3) of the Rules of Procedure 2010 for review of the Order dated 13 November 2013 closing the proceedings of the instant case to allow the Defense to complete their concluding arguments. The Tribunal disposed off the application with observation and allowed Defense to complete their closing arguments in 2 days. Thereafter, the Defense made submissions on charge numbers 16, 3, 8, 1, 10, 7 and 9.     Continue reading

5 November 2013: ICT-1 Daily Summary –Motiur Rahman Nizami, Closing Statements; Abdus Sobhan, Pre-Trial Submissions

Despite a 60-hour nationwide Hartal that kept ICT-2 out of session today, ICT-1 proceeded to hear matters in the following cases:

  1. Chief Prosecutor vs. Motiur Rahman Nizami
  2. Chief Prosecutor vs. Abdus Sobhan

In the case against Abdus Sobhan, today was set for defense hearing on charge matter. However, the Defense sought adjournment for a week. The Tribunal granted the motion and adjourned the proceedings of the case until 18 November 2013.

In the case against Motiur Rahman Nizami, the Prosecution continued submissions for the third day. The Prosecution made pre-trial submissions on charge 2, 3, 4, 6, 7, 8, 9, 10, 15 and 16. Thereafter, the Tribunal adjourned the proceedings of the case until tomorrow, 6 November 2013.

10 October 2013: ICT-2 Special Report – AKM Yusuf, Bail Hearing; Jahir Uddin Jalal alias Bicchu, Contempt Proceedings

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. AKM Yusuf
  2. Chief Prosecutor vs. Jahir Uddin Jalal

On 10 October 2013 heard a bail application from senior Defense counsel Abdur Razzak, on behalf of AKM Yusuf.  Counsel sought release of the Accused on grounds of recent deterioration of his health. The Court directed the jail authorities to submit an updated health report to the Tribunal, reflecting the latest health condition of the Accused. It fixed 23 October 2013 as the next date for passing further orders in regard to his bail.

Also today, the tribunal passed its long awaited order in the contempt proceedings against Jahir Uddin Jalal. These contempt proceeding had received significant attention from the Bangladeshi public, in particular amongst members of the Bar, so we elected to review the charges in detail here, as compiled from previous daily summaries where we covered the matter.

10 September 2013: ICT-2 Daily Summary – Abdul Alim, Prosecution Closing Arguments

Today the Tribunal heard matters in the following case:

1.    Chief Prosecutor vs. Abdul Alim

Prosecutor Dr Tureen Afroz made her closing submission on points of law before Tribunal 2 in the case against Abdul Alim. Previously, Prosecutor Rana Das Gupta had finished the Prosecution submission on evidentiary aspects of the case. This marked the end of prosecution case against Alim. The defense closing argument is scheduled to commence from 15 September 2013. Continue reading
