1-5 September 2013: ICT-1 Daily Summaries

From 1 to 5 September 2013 our observer was on leave. These summaries have been compiled from media coverage of the proceedings:

Summary of 1st September
In case of Motiur Rahman Nizami, the Defense conducted the cross-examination of Johurul Haque, Prosecution witness 18. Thereafter, Tribunal adjourned the proceedings of the case until tomorrow, 2 September 2013.

Summary of 2nd September
On 22 August Tribunal heard a petition filed by the Prosecution requesting the Tribunal to issue an order of contempt under section 11(4) of the ICT Act 1973 and Rule 45 of the Rules of Procedure against Human Rights Watch Board of Directors, Executive Director of Asia Division Brad Adams, and Associate of Asia Division Storm Tiv.

Today, 2 September 2013, Tribunal issued a notice to Human Rights Watch Board of Directors, Executive Director of Asia Division Brad Adams, and Associate of Asia Division Storm Tiv asking them to submit an explanation within three weeks as  to why contempt proceedings should not be brought against them for the publication an article regarding the Judgment in the Ghulam Azam case. The Tribunal instructed  the concerned authorities to supply the notice to the opposite parties through the Ministry of Foreign Affairs.

In the case of Motiur Rahman Nizami, Tribunal recorded the testimony of Abu Shama Fakir, Prosecution witness 19 and scheduled the cross-examination for September 8th. Tribunal also passed a suo moto order saying that from 8 September the trial of Nizami would be heard on every working day. They additionally directed the jail authorities not to produce the Accused before any other trial court without prior permission from the Tribunal.

Summary of 3rd September
In the case of ATM Azharul Islam, the Prosecution concluded their submissions on the proposed framing of charges. The Defense requested adjournment, saying they needed time for preparation. The Tribunal scheduled the Defense’s submissions for 8 September.

Summary of 4th September
In the case of Mobarak Hossain, the Tribunal recorded the testimony of Bhanu Bibi, Prosecution witness 9. Then Defense conducted the cross-examination. After the conclusion of the cross-examination Tribunal adjourned the proceedings of the case until 11 September 2013.

Summary of 5th September
In the case of Zahid Hossain Khokon, the Prosecution began their submissions on the proposed framing of charges against the accused. They proposed 11 charges against Zahid Hossain Khokon, who is currently absconding. Thereafter, Tribunal adjourned the proceedings of the case until 17 September 2013.

In the case of Mir Qasem Ali, the Defense previously requested that the case be adjourned until after 8 September in order to allow senior Defense counsel Abdur Razzaq to submit arguments in favor of discharge. Abdur Razzak is currently in the USA and therefore unable to attend proceedings. Today was scheduled for the Tribunal to issue its order on the framing of charges. The Defense again submitted an application seeking adjournment until 8 September 2013. The Prosecution opposed the application saying the Defense has been given sufficient time to place their arguments. After hearing both the parties, the Tribunal rejected the application and passed the Charge Framing Order. The Tribunal also rejected the discharge petition and framed 14 charges against the accused. The Tribunal scheduled Opening Statements for 30 September 2013.
