12 March 2013: ICT-1 Daily Summary

The Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Gholam Azam –  Defense Closing Arguments
  2. Chief Prosecutor vs. Salauddin Qader Chowdhury –  Testimony of PW 21
  3. Investigation of Mubarak Hossain – Cognizance of Charges

On March 12, 2013 a junior Defense counsel for Gholam Azam sought adjournment saying that senior Defense attorney Mizanul Islam could not attend due to the personal difficulties. The Tribunal accepted the Defense prayer and adjourned the proceedings of the Gholam Azam’s case until March 13. The charged the Defense taka 1,000 for the cost of the delay.

The Tribunal took cognizance of the formal charge against Mubarak Hossain and ordered him to be detained in jail, rejecting the Defense request for an extension of bail. The Tribunal fixed 4 April 2013 for the next date of hearing.

In the Chowdhury case Prosecution witness 21, Abul Bashar, testified before the Tribunal. Thereafter, Tribunal adjourned the proceedings of the Chowdhury case until 18 March 2013.

11 March 2013: ICT-1 Daily Summary – Gholam Azam Closing Arguments, Mubarak Hossain Pre-Trial Proceedings

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs Gholam Azam: Defense Closing Arguments (Accused Not Present)
  2. Chief Prosecutor vs Mubarak Hossain: Pre-Trial Proceedings, Cognizance of Charges to be Announced Tomorrow (Accused Not Present)

On March 11, 2013 Defense counsel Mizanul Islam continued the Closing Arguments for the 2nd consecutive day. He submitted arguments regarding Prosecution witnesses 16 and 1. Thereafter, Tribunal adjourned the proceedings of the Gholam Azam’s case until tomorrow, 12 March 2013.

The case against Mubarak Hossain was listed in the Cause List as being scheduled for Cognizance. The Chairman of Tribunal 1 asked the Prosecution to provide the Formal Charge, list of witnesses and other relevant documents to Mubarak Hossain’s Defense counsel, as the Prosecution admitted that they have not yet served the documents to the Defense. Prosecutor Haider Ali drew the Tribunal’s attention to the Cause List where the case was listed as a miscellaneous case instead of a separate case. Thereafter the Tribunal decided to give its order tomorrow (12 March 2013) regarding the Tribunal’s cognizance of the charges.

25 Feb 2013: ICT-1 Daily Summary – Gholam Azam Closing Arguments

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Gholam Azam: Prosecution Closing Arguments (Accused Not Present)
  2. Chief Prosecutor vs. Mubarak Hossain (Accused Not Present)

In the Gholam Azam case the Tribunal heard the Prosecution’s closing arguments for the 6th consecutive day. Prosecutor Sultan Mahmud Simon submitted arguments in support of Charge 3 (incitement) from counts 26 to 28 and Charge 4 (complicity) for counts 1 through 13. Thereafter, Tribunal adjourned the proceedings until February 26, 2013.

The Prosecution submitted the Formal Charges against Mubarak Hossain but the matter was not argued or presented in open court. Continue reading

Weekly Digest: Issue 4 – February 10-14, 2013

This week’s digest details the ongoing progress of the Gholam Azam, Nizami, and Chowdhury cases in Tribunal 1. The Tribunal also heard matters regarding the ongoing investigations against Abdus Shobhan and Mubarak Hossain. In the Gholam Azam case the Prosecution completed its cross-examination of Defense witness 1 and the Tribunal scheduled February 17th for Closing Arguments, despite requests from the Defense for more time to produce additional witnesses. In the Chowdhury case the cross-examination of Prosecution witness 17 took place in-camera, and direct and cross-examination of Prosecution witnesses 19 and 20 was completed. The Nizami case experienced delays, as Defense counsel were unable to reach the Tribunal due to ongoing violence in the Palton neighborhood of Dhaka (where their offices are located).

Tribunal 2 heard the cross-examination of the Investigating Officer in the Kamaruzzaman case, who appeared in Court as Prosecution witness 18. In the  Mujahid case The Defense also cross-examined Prosecution witness 1. In the Abdul Alim the Defense cross-examined prosecution witness 10. The Tribunal additionally granted additional time to Home Minister Mohiuddin Khan Alamgir to respond to contempt proceedings against him.

12 Feb 2013: ICT-1 Daily Summary – Chowdhury Direct and Cross-Examination of PW 19

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs Mobarak Hossain: Report on Investigation and Date for Submission of Formal Charges (Accused Present)
  2. Chief Prosecutor vs Abdus Sobhan  (Accused Not Present)
  3. Chief Prosecutor vs Salauddin Quader Chowdhury (Accused Present)

The Prosecution requested an additional seven days before submitting their Formal Charge against Mubarak Hossain. The Tribunal allowed their prayer and fixed February 25, 2013 for submitting the Formal Charge and extended the bail period till February 25, 2013.

On February 11, 2013 Tribunal heard an application filed by Abdur Razzaq requesting that law enforcement cease harassing Motiur Rahman Akond, Defense Counsel for Abdus Sobhan. Today the Tribunal passed an order directing the law enforcement agencies not to harass Motiur Rahman Akond.

Today, Wahidul Alam Junu, prosecution witness 19 in the Salauddin Quader Chowdhury case, concluded placing his testimony and Defense counsel Ahsanul Huq Hena concluded his cross-examination. Thereafter, Tribunal adjourned the proceedings till February 14, 2013.   Continue reading
