14 November 2013: ICT-2 Daily Summary– AKM Yusuf PW-4 and PW-5

Today the Tribunal heard matters in the following case: 

  1. Chief Prosecutor vs. AKM Yusuf

Today the Tribunal recorded the cross-examination of PW-4 and the examination-in-chief of PW-5 in the case against AKM Yusuf.  The Defense also began cross-examination of PW-5.  They did not complete this before the end of today’s session, so it  was scheduled to be completed on 17 November 2013. 1 September 2013: ICT-2 Daily Summary – Alim DW 2, Khan& Mueen Uddin PW 20

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Abdul Alim
  2. Chief Prosecutor vs. Ashrafuzzaman Khan &Chowdhury Mueen Uddin

In the Abdul Alim case, Tribunal 2 recorded the examination-in-chief and cross-examination of Defense witness 2. Additionally, in the case of Ashrafuzzaman Khan and Chowdhury Mueen Uddin, who are jointly being tried in absentia, the Tribunal recorded the testimony of Prosecution witness 20. The witness’ testimony supports Charge 7, concerning the abduction and killing of Professor Mofazzal Haider Chowdhury.  The testimony also refers to the killing of Professor A.M. Munir Chowdhury, contained within Charge 8. Continue reading

26 August 2013: ICT-2 Daily Summary – AKM Yusuf Order On Defense Application

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. AKM Yusuf

Today Tribunal 2 rejected a review application filed by the Defense on behalf of AKM Yusuf seeking review of the Charge Framing Order.  Only two members of the bench were present, Justice Mozibur Rahman Miah and Justice Md Shahinur Islam. Jointly they issued an order summarily rejecting the petition by reason of the Defense’s delay in submitting the application. The Tribunal did not accept the Defense’s argument that the delay in filing the application was due to a delay in obtaining a certified copy of the original Charge Framing Order. No other cases were listed in the court ‘s daily cause list and Chairman of Tribunal 2, Justice Obaidul Hassan, is currently on leave. The Tribunal then adjourned for the day.

25 August 2013: ICT-2 Daily Summary – Khan & Mueen Uddin PW 17

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Ashrafuzzaman Khan and Chowdhury Mueen Uddin

Today Tribunal 2 recorded the testimony of Prosecution witness 17 in the case against Ashrafuzzaman Khan and Chowdhury Mueen Uddin, both of whom are being tried in absentia. The testimony of the witness is relevant to the background identification of Ashrafuzzaman Khan.  Continue reading

14 August 2013: ICT-2 Daily Summary – Khan and Mueen Uddin PW 12

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Ashrafuzzaman Khan and Chowdhury Mueen Uddinin absentia

Today Tribunal 2 recorded the testimony of Prosecution witness 12, Mr Anirban Mostafa, the son of martyred journalist ANM Golam Mostafa. The witness testified regarding Charge 3. The Prosecution asserted that his testimony corroborates that of his uncle ANM Golam Rahman Dulu, who testified as Prosecution witness 8 on 31 July 2013.

The witness testified that he is the son of victim ANM Golam Mostafa ,who was killed in the massacre of Bangladesh’s intellectual community on 15 December 1971.  He stated that he was only a few months old in 1971. He learned about his father’s abduction from his mother, his uncles, and newspaper reports.    Continue reading

13 August 2013: ICT-2 Daily Summary – Hartal Coverage of Khan and Mueen Uddin PW 10

Today a nation-wide hartal was called in response to the revocation of Jamaat’s registration as a political party on 2 August 2013. Jamaat postponed the hartal in order to allow people time to return home from Eid related travels. Today’s coverage is therefore gathered from media sources and from conversations with the Prosecution and the Defense teams.

12 August 2013: ICT-2 Daily Summary – Reappointment of Justice Shahinur Islam

Tribunal 2 was not in session today. However, Justice Md. Shahinur Islam was officially re-appointed to Tribunal 2 after having been sworn in as an additional Supreme Court Judge on 5 August 2013.  Justice Md Shahinur Islam began serving as a member of the International Crimes Tribunal 2 on 25th March 2012. Recently on 31st July, 2013, he was appointed as an Additional Judge of the High Court Division (HCD) of the Supreme Court of Bangladesh, in accordance with the nomination of Mr Justice Md Muzammel Hossain, the Chief Justice of Bangladesh. As per Article 95(1) of the Constitution of the People’s Republic of Bangladesh, Judges of the Supreme Court are appointed by the President in consultation with the Chief Justice. Article 98 of the Constitution authorizes the appointment of one or more duly qualified persons to be Additional Supreme Court Judges. Accordingly, After taking the oath on 5 August 2013 Justice Md. Shahinur Islam was officially considered discharged from his previous position as a Member of Tribunal 2. Today he was reappointed to the Tribunal. 

Prior to his previous appointment as a Member of Tribunal 2, Justice Shahinur was the Registrar of the International Crimes Tribunal. He joined the judiciary of Bangladesh as a Judge in April, 1983 and was promoted to the position of District Judge in January 2001
