25 Feb 2013: ICT-2 Daily Summary – Kamaruzzaman Defense Applications, Alim Continuance

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Muhammad Kamaruzzaman: Two Defense Applications
  2. Chief Prosecutor vs. Abdul Alim: Defens Request for Additional Time

Today the Tribunal heard two Defense applications in the Kamaruzzaman case. The first was an application to recall the court’s order ending the cross-examination of Prosecution witness18, the Investigation Officer. The order was issued after Defense counsel Kafil Uddin Chowdhury failed to complete the cross-examination within the time stipulated by the court. On 20 February 2013 (Wednesday), the court instructed the Defense to finish the cross-examination before lunch break on Sunday, February 24th. The Defense was absent on Sunday however, due to the ongoing hartal (strike). The Tribunal nonetheless announced that the cross-examination was completed after the lunch recess on the 24th. The second application was a request to allow the Defense to submit additional documents into evidence.

In the Alim case the Tribunal granted a request from the Defense for additional time due to the inability of the senior Defense counsel to attend.

19 Feb 2013: ICT 1 Daily Summary – Gholam Azam Prosecution Closing Arguments on Command Responsibility and Charge 1

Today the Tribunal heard matters in the following cases:

1. Chief Prosecutor vs. Gholam Azam – Prosecution Closing Arguments (Accused Not Present)

Today the Prosecution continued presenting its closing arguments for the 3rd consecutive day. Today, Prosecutor Sultan Mahmud Simon focused his arguments on proof of Gholam Azam’s superior status and liability under the doctrine of command responsibility. The Prosecution additionally summarized their arguments in support of Charge No 1, addressing 6 specific instances of alleged conspiracy contained within that Charge. Thereafter, Tribunal adjourned until February 20, 2013.

14 Feb 2013: ICT-2 Daily Summary – Contempt Proceedings, Kamaruzzaman Cross-Examination of PW 18

Today the Tribunal heard matters in the following cases:

  1. Contempt Proceedings against Home Minister Mohiuddin Khan Alamgir
  2. Chief Prosecutor vs. Muhammad Kamaruzzaman: Cross-Examination of PW 18 (Accused Present)

The Tribunal first heard a request for more time on behalf of the Home Minister, Mohiuddin Khan Alamgir, who is facing contempt charges based on comments made about the timing of verdicts to be issued by the Tribunal.

The court then proceeded to the case against Muhammad Kamaruzzaman wherein defense counsel Mr Kafil Uddin Chowdhury resumed the cross-examination of PW-18, Mr Abdur Razzaq,  the Investigation Officer of the case.  Continue reading

10 Feb 2013: ICT-1 Daily Summary – Gholam Azam cross-examination of DW-1

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs Gholam Azam – Cross-examination of DW-1 (Accused Not Present)
  2. Chief Prosecutor vs Salauddin Quader Chowdhury: Cross-examination of PW 17 in-camera (Accused Present)

A number of administrative matters were brought to the attention of the Tribunal, including allegations of harassment of Defense counsel, in-camera examination of the witness, and Chowdhury’s counsel.

The Tribunal then began addressing items in the cause list, beginning with the Gholam Azam case. The Prosecution continued its cross-examination of DW 1, Abdullahil Aman Azmi, who is the son of Gholam Azam and a former Army personnel.

After the mid-day break Defense counsel for Salauddin Qader Chowdhury began their cross-examination of prosecution witness 17 in-camera.

7 Feb 2013: ICT-2 Daily Summary – Kamaruzzaman re-examination of PW 16, Contempt against Jamaat

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Muhammad Kamaruzzaman – Re-examination of prosecution witness  (Accused Not Present)

At the beginning of the day’s proceedings senior Defense counsel Mr Tajul Islam  expressed his concern and dissatisfaction regarding access and entry of defense counsel at the Tribunal gate.

The court then moved to Muhammad Kamaruzzaman’s case wherein the prosecution witness PW-16, Mr. Azabuddin Miah, was re-examined by the Prosecution. Mr. Miah is the Assistant Librarian of Bangla Academy (Newspaper Branch) and is testifying before the tribunal as to the authenticity of various newspapers collected from the Bangla Academy archive by the Investigation Officer.
