20 March 2013: ICT-2 Daily Summary – Adjournement in Kamaruzzaman and Mujahid, Alim Cross-Examination of PW 13

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Kamaruzzaman – Extension of Time for Production of DW
  2. Chief Prosecuor vs. Mujahid: Adjournment
  3. Chief Prosecutor vs Abdul Alim: Cross-Examination of PW 13

The case against Mujahid was listed for the hearing of the Defense review application and for the examination of the prosecution witness. However, the Defense counsel requested adjournment of court due to the death of one attorney’s mother. The Prosecution did not object to the same and the court adjourned the matter till Sunday, 24 March 2013.

In the Kamaruzzman case the Defense also sought additional time as the Defense witness could not be presented before the court. The Defense counsel said that they could not produce the witness because travel into Dhaka from Sherpur was not possible due to the hartals. The Tribunal adjourned the matter for one day and ordered that the witness be produced on 21 March 2013. At this point, the Tribunal expressed its dissatisfaction for the repeated requests for additional time from the D, particularly with regard to the timely production of Defense witnesses. The Defense argued often granted the Prosecution similar adjournments, and had even given 24 days of additional time for the production of PW-12. Thus they argued that there is an imbalance between the court’s attitudes toward the two parties and that the Defense were being prejudiced. The Tribunal rejected this argument and stated that because the onus to establish an independent case lies with the Prosecution and not the Defense, the Tribunal granted the Prosecution additional time. They said the Defense cannot be allowed to delay the proceeding by referring to such examples.

Finally, in the case Abdul Alim, the defense cross-examined PW-13. Prosecution witness 13 is the nephew of PW 2 Laily Begum and is the grand child of martyr Doctor Abul Kashem, who according to the Prosecution’s case was killed on 25July 1971 in Kuthibari at the instruction of Abdul Alim. The witness was examined by the prosecution on Sunday, 17 March 2013.

Today the Tribunal heard matters in the following cases:

  1. Contempt Proceedings against Jamaat leader Selim Uddin (Present), Daily Shongram (warning made to present journalist), and MK Anwar (Not Present),
  2. Chief Prosecutor vs. Ali Ahsan Muhammad Mujahid : Order of three applications and examination of prosecution witnesses  (Accused Not Present)
  3. Chief Prosecutor vs. Muhammad Kamaruzzaman: Cross-Examination of Defense witness 1, Direct and Cross-Examination of Cross-Examination Defense Witness 2 (Accused Present)
  4. Chief Prosecutor vs. Abdul Alim : Adjourned Due to Illness of Prosecution Witness

Today the Tribunal dealt with ongoing contempt proceedings against Jamaat leaders, MK the Daily Shongram, and MK Anwar. In the Mujahid case the Tribunal disposed of three Defense applications and then heard the direct examination of Prosecution witnesses 14, 15 and 16, all of whom are expert witnesses regarding documentary and historical evidence. In the Kamaruzzaman case the Tribunal heard the cross-examination of Defense witness 1, and both direct and cross-examination of Defense witness 2. Finally, in the case of Abdul Alim the Tribunal allowed an adjournment due to the illness of the Prosecution witness scheduled to testify.

27 Feb 2013: ICT-2 Daily Summary – Alim Adjournment and Fine

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Abdul Alim – Defense Petition for Time and Adjournment (Accused Present)

The Defense for Alim submitted a time petition before the Tribunal-2 requesting an adjournment of the case until Sunday, 3 March 2013. The Defense counsel said that the two other senior counsels engaged in the case are currently unavailable, one by reason of his illness and the other because of personal difficulty. The Tribunal Chairman commented that in the interest of justice the Tribunal must grant additional time when counsel is unable to appear because of personal difficulty. However, he stated that such absences cannot continue frequently and continuously. The delay should be compensated by cost implications. Prosecutor Rana Das Gupta submitted that the Defense should pay a cost of Taka 50,000 (fifty thousand), so as to communicate a message to everyone that causing delay will come with burdensome consequences.

The Tribunal adjourned the case until Sunday, requiring the Defense counsel to pay a total of Taka 2,000. The court said that this shall be paid from the counsel’s own pocket and the client should not pay or bear any burden. The Defense counsel said the fine would be paid and apologized for the unwanted delay in the proceedings.

Weekly Digest, Issue No. 1 – January 20-24, 2013

This is the first issue of the Weekly Digest, a summary of proceedings at the International Crimes Tribunal that will be published on a weekly basis. These reports are designed to provide an overview of events in a digestible manner, suitable to those who want to stay abreast of the proceedings but do not have the time to follow the Daily Summaries.

This week the Tribunal issued its first verdict, the judgment in the Case of Chief Prosecutor vs. Abul Kalam Azad, alias Bachu. The Defendant was tried in absentia by Tribunal 2, and found guilty of six counts of crimes against humanity and one count of genocide. He was sentenced to death by hanging. Tribunal 1 primarily heard the Defense’s closing arguments in Chief Prosecutor vs. Delwar Hossain Sayedee. The Tribunal additionally addressed applications for the removal of Prosecutor Zead al-Malum among other matters.

Weekly Digest, Issue 1 – Jan 20-24

15 Jan 2013: ICT 2 Daily Summary – Qader Molla, Alim, Mujahid

The Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Abdul Quader Molla – Defense closing arguments  (Accused Present)
  2. Chief Prosecutor vs. Abdul Alim– Examination of Prosecution Witness (Accused Present)
  3. Chief Prosecutor vs. Ali Ahsan Muhammad Mujahid – Examination of Prosecution Witness (Accused Present)

In the case of Qader Molla the Defense continued its closing arguments, attacking the prosecution’s evidence in support of charges 5 and 6. In particular they attacked the credibility of witnesses who had testified in support of the charges. The Tribunal urged them to complete their arguments and stated that they would only have one hour during tomorrow’s session to do so.

In the case against Mujahid, the Prosecution conducted its examination-in-chief of their 12th witness, who provided testimony in support of Charge 7, pertaining to the killing of the witness’ brothe,r Biren Shaha, along with 8 to 9 others from the Hindu community on 13 May 1971.

Finally, in the case against A.M.Alim, the Prosecution conducted its examination-in-chief of their 9th witness, Jahidul Islam, who testified in support of Charge 6, pertaining to the killing of Abdus Salam and nine others in early May 1971, as the victims were fleeing the conflict on their way to India.
