25 July 2013: ICT-1 Daily Summary – ATM Azharul Islam Cognizance of Charges, Mir Qasem Ali Defense Applications

Today the Tribunal heard matters in the following cases:

  1. Pre-trial Proceedings against ATM Azharul Islam
  2. Pre-trial Proceedings against Mir Qasem Ali

Today in pre-trial proceedings against suspect ATM Azharul Islam the Prosecution submitted the Formal Charge before the Tribunal. The Tribunal passed an order taking cognizance of the Formal Charge and numbered the case as ICT BD Case No 5 of 2013. The Tribunal also directed the Prosecution to supply the Defense with all of the documents on which the Prosecution intends to rely, as well as the full list of proposed witnesses by the end of the day. They scheduled 18 August for hearing arguments regarding framing of the charges.

The Tribunal also heard an application filed by Alim’s Defense counsel requesting medically appropriate transportation of the suspect to and from the Tribunal. The Defense submitted that the ATM Azharul Islam suffers from back pain but is transported by prison van. The Prosecution objected saying that if such accommodation was made available to all it would create difficulties for the jail authorities due to the shortage of health friendly vehicles. The Tribunal passed an order directing the jail authority to provide ATM Azharul Islam health friendly vehicle if such vehicle is available to the prison authority.

In the pre-trial proceedings against suspect Mir Qasem Ali the Tribunal heard a Defense application seeking adjournment. The Defense submitted that they need privileged communication with their client Mir Qasem Ali. The Defense also requested legible copies of some Prosecution documents. The Tribunal rejected the request for adjournment but scheduled 28 July and 1 August from 10 am to 1 pm for privileged communication between the Defense and their client. They also directed the Prosecution to supply legible copies of the concerned documents if possible. They then heard the Prosecution’s submissions regarding the proposed charges against Ali.

The Prosecution submitted that until 6 November 1971, Mir Qasem Ali was the secretary of the Islami Chhatra Shangho Chittagong division. Between 6 November and 16 December 1971 they claimed that the Accused was also the general secretary of the Provincial Committee of the Islami Chhatra Shangho. They alleged that Mir Qasem was ‘Al-Badr high command.’ Most of the crimes allegedly committed under the leadership of Qasem Ali of took place at Dalim Hotel. The Prosecution briefly read out the 14 charges proposed against Mir Qasem Ali and stated that they had submitted the investigation report, a book titled ‘Muktijudder Potovumi’ vol- 1 and 2, witness statements, map of the place of occurrence, photos, and CDs in support of the charges. The charges are proposed under sections 3(2)(a), 3(2)(g), and 3(2)(h), indicating allegations of crimes against humanity; attempt, abetment or conspiracy; and complicity. The proposed charges are also framed indicating sections 4(1) and 4(2) as the relevant modes of liability, encompassing joint criminal liability and command responsibility respectively. Among the 14 charges proposed, charges 11 and 12 are for murder while the rest are for confinement, abduction, torture and other inhumane acts.

24 July 2013: ICT-2 Daily Summary – AKM Yusuf Charge Framing Order, Khan and Mueen Uddin PW 5, Alim PW

Today the Tribunal heard matters in the following cases:

  1. Pre-trial Proceedings against AKM Yusuf
  2. Chief Prosecutor vs. Ashrafuzzaman Khan and Chowdhury Mueen Uddin
  3. Chief Prosecutor vs. Abdul Alim 

Today Tribunal began by hearing a bail application on behalf of AKM Yusuf. The Defense presented arguments both regarding the necessity of bail, and the insufficiency of the charges proposed against AKM Yusuf by the Prosecution. They argued that the suspect should be discharged as the allegations against him are malafide and inspired by political motivations. The Tribunal also heard the Prosecution’s response. They  scheduled 1 August for issuing their order regarding bail and the potential framing of charges against the suspect. They instructed the jail authorities to submit a report on the availability of their medical facilities and their ability to meet the needs of the suspect while in custody.

The Tribunal then turned to the case of Ashrafuzzaman Khan and Chowdhury Mueen Uddin in which the Prosecution  called Prosecution witness 5 to testify in support of Charge 6. As the trials are being conducted in absentia,  state appointed Defense counsel Shukur Khan and Tuny will be allowed to conduct the cross examination at a later date on behalf of Ashrafuzzaman Khan and Chowdhury Mueen Uddin respectively.

In the Alim case the Tribunal rejected an application from the Defense requesting additional time due to the illness of senior Defense counsel Ahsanul Huq Hena. A junior Defense attorney stated that Hena is physically unwell and is undergoing treatment at the United Hospital. The Tribunal was critical of the delayed application and stated that it would briefly begin the examination of the Investigation Officer and would continue  it the following day. Thus the tribunal very briefly started recording the examination of the Io, but then fixed 25 July 2013 as the date for recording his entire testimony. Continue reading →

18 July 2013: ICT-1 Daily Summary – Hartal Limited Coverage

Today the Tribunal heard matters in the following cases:

  1. Investigation of Zahid Hossain Khokon
  2. Contempt Proceedings – The Economist: Adam Roberts and Others
  3. Investigation of ATM Azharul Islam
  4. Investigation of Mir Qasem Ali
  5. Chief Prosecutor vs. Salauddin Qader Chowhdury

Today the Tribunal 1 issued a warrant for the arrest of Zahid Hossain Khokon after taking cognizance of the charges brought against him. July 30 is scheduled for the hearing of the charges.

The Tribunal then addressed ongoing contempt proceedings against Adam Roberts as the South Asian Bureau Chief of the Economist. On 6 December 2012, the former chairman of the Tribunal announced that he had been called by a person from the Economist and asked for verification regarding alleged skype conversations with foreign legal expert and activist Ahmed Ziauddin. Subsequently the Tribunal issued an order for the Economist to show cause for their ‘interference with the ongoing trial and violating the privacy of a judge.’ On 25 March 2013, Mustafizur Rahman submitted a written reply on behalf of Economist. Today, 18 July 2013, Tribunal heard arguments from both Roberts’ representative and the Prosecution. They fixed 27 August for passing the Tribunal’s order on the matter.

The Prosecution submitted the Formal Charge against ATM Azharul Islam to the Office of the Registrar and informed the Tribunal. The Tribunal set 24 July for the decision of taking cognizance of charges.

Today was fixed for the charge hearing against Mir Qasem Ali. However, the Defense sought six weeks time for additional preparation. The Tribunal scheduled the hearing for 25 July.

In the Chowdhury case the cross-examination of the Defense Witness 3, Qayyum Reza Chowdhury, was also scheduled. However the Defense requested an adjournment. The Tribunal allowed the prayer and fixed 21 July for cross-examination of the witness.

14 July 2013: ICT-2 Daily Summary – AKM Yusuf Charge Hearing

Today the Tribunal heard matters in the following cases:

  1. Pre-trial stage of AKM Yusuf case 

Today Tribunal 2 heard the proposed charges against AKM Yusuf from the Prosecution. They shcheduled 18 July 2013 for the hearing of the Defense’s reply, following which the Charge Framing Order will be passed. After the Prosecution concluded its hearing on the charge framing, the Defense submitted an application requesting privileged communication with the Defendant who is being held in pre-trial detention. .The request was granted. Although the Defense also requested two days additional time for case preparation prior to communication with the Accused, the Tribunal emphasized the need to deal with the cases expeditiously and scheduled the meeting for 17 July 2013, from 10 a.m. until 1 p.m. Two members of the Defense team will meet AKM Yusuf in jail for privileged communication.

24 June 2013: ICT-2 Daily Summary – Mueen Uddin and Khan Charge Framing Order

Today the Tribunal heard matters in the following cases:

  1. Chief Prosecutor vs. Chowdhury Mueen Uddin and Ashrafuzzaman Khan

Today, Tribunal formally read out its Charge Framing Order against the Accused Chowdhury Mueen Uddin and Ashrafuzzaman Khan, who are being tried in absentia for their alleged roles during Bangladesh’s War of Liberation in 1971. Both the Accused are outside of Bangladesh and have not appeared before the Tribunal, with Uddin believed to be in London and Ashrafuzzaman in New York. On June 16, 2013, the prosecution read out its formal charges before the Tribunal, and alleged that Mueen Uddin was the “operation-in-charge” of Al-Badr, while Ashrafuzzaman acted as its chief executor. Both of the Accused are thus alleged to have directly participated in the killing of Bengali intellectuals and professionals who were brutally targeted between the 10th and 15th of December, 1971, including journalist Dr. Shahidullah Kaiser. Many individuals were allegedly abducted and tortured by the Accused.

ICT-2 took cognizance of the case after the Prosecution, in the last week of April 2013, pressed charges for crimes under the ICT Act of 1973 against the two Accused. On May 12, 2013, the police submitted an official report to the Tribunal, noting that the two Accused could not be arrested as they resided outside of Bangladesh, Mueen Uddin in the United Kingdom and Ashrafuzzaman in the United States. Having received this report from the police, the Tribunal issued an order to its Registrar’s Office to publish an advertisement in two widely-circulated national dailies requesting the two Accused to appear before the Tribunal within 10 days of its publication, and stating that failure to do so would lead to trial-in-absentia. On May 22, 2013, the Prosecution informed the Tribunal that notices had been published on May 14, 2013 in the Daily Janakantha, and on May 15, 2013 in the Daily Star, asking the Accused to submit to the Tribunal with 10 days of publication. The advertisements did not lead the Accused to appear. Finally, on May 27, 2013, ICT-2 noted that the two Accused have absconded, and accordingly ordered their trial to commence in absentia. Abdus Shukur Khan and Salma Hye Tuni, two advocates of the Supreme Court of Bangladesh, were appointed by the Tribunal to serve as counsels to defend both of the Accused.

After hearing the proposed charges were read out by the Prosecution on June 16, 2013, the Tribunal fixed today as the date for to read out the Charge Framing Order. Justice Obaidul Hassan, the Chairman of Tribunal 2, read out the Charge Framing Order in the presence of his fellow Justices Mozibur Rahman Mia and Shahinur Islam.
